2. Website hosting and technical operation

Our website is hosted and operated using the Wix platform. The service provider is Wix.com Ltd., 5 Yunitsman Street, Tel Aviv, Israel. Wix’s representative in the European Union is Wix Online Platforms Limited, 1 Grant’s Row, Dublin 2, D02HX96, Ireland.

When you visit the website, certain technical information is processed automatically so that the site can be displayed securely and reliably. This may include your IP address, the date and time of your visit, the page requested, the volume of data transferred, your browser and operating system, the referring page, and technical error or security information.

This processing is based on Article 6(1)(f) GDPR. Our legitimate interest is to provide a secure, stable and user-friendly website and to protect it against misuse.

Wix processes personal data on our behalf under a data processing agreement. Wix and its subprocessors may also process data outside the European Economic Area. The European Commission has recognised Israel as providing an adequate level of data protection. Where data are transferred to other countries, Wix states that it relies on an applicable adequacy decision or appropriate safeguards, such as the European Commission’s Standard Contractual Clauses or, where applicable, the EU-US Data Privacy Framework.

Technical log data are retained only for as long as needed to operate and secure the website, investigate technical issues and prevent misuse, unless a longer retention period is required by law or justified by compelling legitimate grounds.

3. Essential cookies and similar technologies

This website uses only cookies and similar technologies that are necessary for the secure and reliable operation of the Wix platform. They support functions such as system security, network management, fraud prevention and technical stability.

Where information is stored on, or accessed from, your device, this is done under section 25(2), no. 2 of the German Telecommunications Digital Services Data Protection Act (TDDDG), because the technology is strictly necessary to provide the website you have requested. Where personal data are processed in this context, the legal basis is Article 6(1)(f) GDPR.

We do not use cookies or similar technologies for analytics, advertising, profiling or marketing.

 

4. Contacting us

You can contact us through the contact form, by email or by telephone. We process the information you provide, which may include your name, contact details, the content of your message and, where relevant, information about your organisation or enquiry.

We use this information to respond to your enquiry. If your message relates to the preparation or performance of a contract, the legal basis is Article 6(1)(b) GDPR. For other enquiries, the legal basis is Article 6(1)(f) GDPR; our legitimate interest is to respond properly and efficiently to business and other communications.

Information submitted through the contact form is processed using Wix’s infrastructure. Emails are also processed by the technical providers we use to operate our email service.

We delete enquiries once they have been fully dealt with, unless we are required or entitled to retain the information for longer. If an enquiry leads to a contractual relationship, relevant records are retained for the applicable commercial and tax-law retention periods.

5. Who may receive your data?

Within HERR & SPEER GmbH, personal data are available only to people who need them for the relevant purpose. We may also share data with carefully selected service providers where this is necessary for website hosting, technical support, email communications or compliance with legal obligations.

We disclose personal data to other recipients only where permitted or required by law, or where you have given your consent.

6. Your data protection rights

Subject to the conditions set out in applicable law, you may request access to your personal data, correction of inaccurate data, erasure, restriction of processing and, where applicable, data portability.

Where processing is based on Article 6(1)(f) GDPR, you may object at any time on grounds relating to your particular situation. We will then stop processing the data concerned unless we can demonstrate compelling legitimate grounds that override your interests, rights and freedoms, or the processing is necessary for the establishment, exercise or defence of legal claims.

8. Is providing personal data mandatory?
